What Is the 14-Day Rule for Car Accidents?

In previous blogs, we’ve discussed the importance of seeking medical treatment after a car accident as soon as possible. This is simply to ensure that any injuries you sustain, even those that may not show symptoms yet, are documented in timely medical records. Doing so makes it easier to prove that your injuries were directly caused in the crash you are filing a claim for.

As a Florida driver, you may or may not know it’s actually required, not just recommended, to seek medical attention within two weeks after your crash in order to file a claim with your own personal injury protection (PIP) coverage. This requirement is known as the 14-day rule.

There are, however, some common areas of confusion surrounding this rule and how it applies to other types of coverage. Below, we discuss more about how the 14-day rule works.

The Limitations of the 14 Day Rule

Since Florida is a no-fault auto insurance state, those injured in accidents will typically turn to their own insurance companies first in order to get compensated for medical expenses, lost wages, and other related losses through PIP coverage.

Here’s the problem: when some people hear that you have to get medically treated to get PIP benefits, some people misunderstand it as you are barred from filing a claim at all if you didn’t get treated within the 14 days. This is not true!

Although you may not be entitled to PIP, which is a valuable benefit, you can still make other claims even if you were not treated within 14 days of the accident, including:

  • Uninsured/underinsured motorist claims
  • Claims against the at-fault driver
